site.btaSupreme Judicial Council's Plenum Postpones Prosecutor General Election
The Plenum of the Supreme Judicial Council postponed on Thursday the election of a prosecutor general. The proposal was made by the Prosecutors Chamber and was presented by its member Georgi Kuzmanov. He was motivated by the amendments to the Judiciary Act adopted by the National Assembly on Wednesday.
The only candidate for the post is the current acting Prosecutor General Borislav Sarafov. He was not present at the meeting.
In the transitional and final provisions of the draft bill on amendments to the Judiciary Act, the MPs adopted that the procedure for the election of prosecutor general, currently underway, is terminated if the law is promulgated by presidential decree before its completion.
The council members voted on a decision that a ruling on the procedure would be made after the promulgation of the legal changes.
The representative of the Supreme Judicial Council Boyan Magdalinchev expressed belief that the voted changes in the Judiciary Act are unconstitutional. Speaking to the media after the Plenum, he said that the Parliament does "whatever it wants".
"We see where things are going, it is more correct to postpone the election of the prosecutor general until the law comes into force," he said.
