Parliament Adopts Rules for Nominating Candidates for Constitutional Court Judge from Parliamentary Quota

The National Assembly adopted on Wednesday procedural rules on the process for nominating candidates, hearing them, and electing a Constitutional Court judge from the parliamentary quota. The rules of procedure were adopted by 112 votes to 67, with 22 abstentions. They were supported by the MPs of the ruling majority comprised of GERB-UDF, BSP – United Left (16), Democracy, Rights and Freedoms – DRF, and There Is Such a People.

According to the provisions, the deadline for nominations of candidates to the Constitutional Court from the quota of the National Assembly shall take place within 14 days of the adoption of the decision. Nominations shall be made by MPs in writing to the Parliamentary Committee on Constitutional and Legal Affairs.

The proposals together with the name and motives of the MP who proposed the candidate will be published within three working days of their receipt on the National Assembly website. Hearing the candidates will take place during an open session of the Committee on Constitutional and Legal Affairs.

The candidate with more than half of the votes of the Members of the National Assembly present shall be deemed elected. If several candidates have received more than half of the votes, the candidate with the highest number of votes in favour shall be elected. If none of the candidates obtains the required votes, the National Assembly shall adopt a decision to open a new election procedure.

Earlier Wednesday, Parliament adopted the rules of procedure for the election of the head of the National Health Insurance Fund, as well as the rules of procedure for the nomination of the chairperson and members of the Energy and Water Regulatory Commission.
