Bulgarian Employers Posting Workers to EU, EEA Countries and Switzerland Must Comply with Minimum Work and Pay Requirements

Sofia, January 9 (BTA) - The General Labour Inspectorate (GLI) Executive Agency recalled in a press release on Monday that new rules apply in Bulgaria as from the beginning of 2017, intended to provide better protection of the labour rights of Bulgarian workers posted by a Bulgarian employer to work in a EU Member State, a State which is a Contracting Party to the Agreement on the European Economic Area or Switzerland. The relevant amendments to the Labour Code was promulgated in the last issue of the Official Gazette for 2016.

Under the revisions, payment of at least the minimum remuneration valid for the receiving State is due from the first day on which the worker began work abroad. Before, the minimum remuneration for the receiving State was mandatory when the posting was for over 30 days.

The employer is obliged to familiarize workers posted in the framework of the provision of services in writing with the conditions for work in the receiving State, as published on the official website of the country concerned. This must be done not later than one working day before the starting date of the posting or employment at the beneficiary undertaking.
