site.btaCC-DB, MECh Petition Constitional Court for Interpretation on Early or Unconstitutional Termination of Governing Bodies Tenure
Continue the Change-Democratic Bulgaria and MECh have petitioned the Constitutional Court (CC) for interpretation in relation to the tenures of governing bodies that were released early, illegally or unconstitutionally.
Vasil Pandov of CC-DB cited two cases as examples - that of the deputy-governor of the Bulgarian National Bank Andrey Gyurov and that of the governor of the National Health Insurance Fund (NHIF) Stanimir Mikhailov. "Our goal is to get a clear answer from the Constitutional Court whether a majority in the National Assembly can overrule the principles of statehood, mandates and separation of powers," Pandov said.
In his words, the majority currently does not have an agenda for governance, but an agenda for the allocation of regulators. He commented that good statesmanship is to wait and see if the Court will admit their request because whoever is elected now will be in an unclear situation. Pandov explained that in the case of the NHIF Governor, whose term expires in March, there is lack of clarity as to whether he was in office at the time he was unconstitutionally removed from office.
Atanas Slavov stressed the importance of the principles of openness, transparency and publicity when such bodies are formed and added that the National Assembly cannot arbitrarily dismiss people from an elected position they have held.
Slavov also commented on an appeal by Acting Prosecutor General Borislav Sarafov to the Supreme Administrative Court against the terminated procedure for the election of the Prosecutor General. According to Slavov, the desire of the court to refer the case to the Constitutional Court is another case of protection of private, personal and guild interest.
