site.btaCourt Declares as Unconstitutional Customs Act Provision

September 19 (BTA) - The Constitutional Court has
declared unconstitutional a provision in the Customs Act, said
National Assembly Deputy Speaker Emil Hristov at the beginning
of Thursday's plenary sitting.

The ruling was reached unanimously by all 11 judges.

The case has been opened on a motion by the Supreme Bar Council
which challenged the constitutionality of the Transitional and
Final Provisions in a bill to amend and supplement the Corporate
 Income Taxation Act which added a second sentence to Article
10, Paragraph 1 of the Customs Act.  Under the disputed
provision customs officers cannot be persons who have been
charged with or are tried on the grounds of intentional publicly
 prosecutable crimes. RY/PP
