Amendments Concerning Central Register of Special Pledges Pass Conclusively

Parliament Wednesday adopted on second reading amendments to the Special Pledges Act concerning the creation, maintenance and development of an electronic Central Register of Special Pledges with the Registry Agency.

The amendments continue the registry reform in the area of special pledges which started in 2016. The revisions provide for the creation of an electronic pledgor's file and the provision of registered access to the case files and electronic forms of documents contained therein. The option of signing applications and other documents in electronic form is ensured.

According to the amendments, the court, the state bodies, the local government and local administration bodies and persons entrusted with a public function, organizations providing public services, including banks, have no right to require proof of circumstances and the presentation of acts which are published in the Central Register of Special Pledges.

Until June 30, 2023, the Central Register of Special Pledges with the Justice Minister provides to the Registry Agency in electronic form, free of charge, the complete data on the circumstances recorded in text format and the electronic form of the documents on whose basis the recordings were effected.

After July 1, 2023, when applications are submitted for recording, deletion or announcement in the Central Register of Special Pledges, the registrar opens ex officio an electronic pledgor's file by retrieving the recorded data and electronic forms of documents.

The MPs also adopted amendments to the Bulgarian Identity Documents Act, which were reported but were not put to the vote on Tuesday.
