The Prosecutor's Office has no power to carry out an investigation into the alert regarding the property on Vrabcha Street in the capital. The statement reminds that the recent amendments to the Constitution have taken away powers of the prosecution service related to the general supervision of legality.
On Tuesday, Continue the Change - Democratic Bulgaria (CC-DB) said they will alert acting Prosecutor General Borislav Sarafov in connection with the building provided by a decision of the Council of Ministers to the Movement for Rights and Freedoms (MRF).
As of the end of 2023, the Prosecutor's Office does not have the powers to carry out a full and comprehensive examination of all the facts and circumstances related to the procedure and the motives of the decision of the Council of Ministers. According to the latest amendments to the Constitution, the supervision of legality as a power of the prosecution service only covers the correct application of substantive and procedural law in resolving issues in a specific criminal proceeding, the statement said.
It also points out that the Prosecutor General's supervision of legality has as its object only the activities of prosecutors, and that this power is exercised within the Prosecutor's Office and has as its object the activities of the bodies which are hierarchically subordinate to him and of which he is the administrative head. This activity is relevant to the performance of the main tasks of the prosecution service.
