site.btaConstitutional Court Rescinds 20% Fee for RES Power Producers

Sofia, July 31 (BTA) - At a siting held on July 31, 2014, the Constitutional Court came out with a pronouncement on Constitutional Case No. 1/2014, the courtТs website said. The case is against the fee of 20 per cent of revenue introduced for producers of electric power from renewable energy sources. The fees were introduced with the Transitional and Final Provisions of the State Budget 2014 Act.

The court has declared unconstitutional the relevant sections of the Final Provisions, after the case was referred to it by President Rosen Plevneliev in the beginning of the year. According to the President, the provisions violate the equal legal conditions for economic activity guaranteed by the Constitution for all citizens and legal persons.

The decision was supported by 10 members of the Constitutional Court.
