Constituional Court Outlaws Internet Traffic Monitoring
Sofia, March 12 (BTA) - The Constitutional Court Thursday
announced its decision that the monitoring of Internet traffic
data is unconstutional. The Court took up the case last April
after an application by the National Ombudsman, Konstantin
Penchev.
Provisions allowing the monitoring of Internet traffic data were
added to the Electronic Communications Act in 2010 in keeping
with the EU Data Retention Directive (Directive 2006/24/EC). In
April 2014, the Grand Chamber of the European Court of Justice
(ECJ) declared the Directive invalid and said that it entailed
serious interference with the rights to privacy and personal
data protection of individuals guaranteed by the Charter of
Fundamental Rights.
EU Members who have transposed the Directive into their national
legal systems are required to ensure compliance with the ECJТs
judgment.
