On Monday, the Supreme Administrative Court left without consideration an appeal submitted by the Democracy, Rights and Freedoms - MRF Coalition , represented by Dzhevdet Chakarov, against the instructions of the Central Electoral Commission (CEC), referring to the administrative review of the submitted application for registration of the coalition.
With the same decision, the magistrates terminated the proceedings in the case.
On September 8, an appeal was lodged by Democracy, Rights and Freedoms - MRF, represented by Dzhevdet Chakarov, against the instructions of the Central Election Commission of September 4 in connection with the consideration of the coalition’s application for registration in the October 27 early parliamentary elections. Simultaneously, a motion to withdraw the appeal was filed at the court.
By order of the same day, the Supreme Administrative Court gave the Coalition Democracy, Rights and Freedoms - MRF until 9:30 am on Monday to provide a power of attorney to withdraw the filed complaint. The court's instructions were complied with and the coalition submitted the power of attorney within the stipulated time.
The court decided that that the appeal is inadmissible, because with the application of September 8, it was withdrawn, therefore the court does not owe a ruling on it. The second reason is that the instructions of the CEC for the elimination of incompleteness or inconsistencies in coalition registration documents are not subject to independent judicial appeal. Only the refusal of registration can be appealed to the Supreme Court, the court added.
The court explained that an inadmissible complaint cannot be considered and therefore the case is closed.
Earlier in the day, the CEC refused to register the coalition Democracy, Rights and Freedoms - MRF and MRF - New Beginning"for participation in the upcoming early parliamentary vote on October 27.
