site.btaLabour Code Amendments on Distance Work Approved Conclusively at Committee Stage

The parliamentary Committee on Labour, Social and Demographic Policy on Wednesday approved conclusively Government-proposed draft amendments to the Labour Code related to distance work.

Under the revisions, employers would be less liable for an accident at work to which the victim contributed by gross negligence and where, in the case of distance work, the victim has failed to comply with the prescribed rules and standards for health and safety at work.

According to another provision, where the employer is a direct subcontractor of a service contract, the main contractor would incur solidary liability for the guaranteed payment of the employees' labour remuneration. The main contractor's liability would be limited to the employee's rights arising from the contractual relations between the contractor and the employer. The contractors will not be liable if they have fulfilled or are fulfilling their obligations under their contract with the employer accurately and in good faith. 

The reasoning to the bill says that the proposed revisions are intended to improve labour legislation, ensuring greater flexicurity in distance work.
