Court Upholds Class Action against CEZ by Consumer Protection Commission

Sofia, August 24 (BTA) - The Supreme Court of Cassation has
upheld a class action filed by the Commission for Consumer
Protection against CEZ Distribution Bulgaria, the Commission
said on Monday.

In violation of the law the electricity distributor required of
its customers to pay bills which have been contested or in cases
 when meter tampering has been suspected without any evidence.
This was possible under unfair terms laid out in the service
contracts.

Under the court ruling, CEZ has to strike the unfair terms from
the contract within two months.

Experts of the Commission for Consumer Protection say that
consumers who feel their rights have been violated by the
existing unfair terms could seek court action based on this
ruling.

More class actions have been opened against energy distributors
for declaring void unfair terms which they failed to remove
voluntarily on a recommendation by the Commission.
