site.btaSupreme Court Upholds Ban on Building Development in Unique Dunes at Coastal Resort

October 22 (BTA) - Bulgaria's Supreme Administrative Court (SAC) has left standing a judgment of the Bourgas Administrative Court that dismissed an appeal against a ban on the construction of a recreation and resort building in the Kavatsite locality (3 km south of Sozopol, on the Southern Bulgarian Black Sea coast), the SAC said in a press release on Friday.

The first-instance court banned the construction project, admitting an expert witness's conclusion that fixed coastal (grey) dunes with herbaceous vegetation had been identified within the boundaries of the property.

According to the conclusion, drawn up by a Chief Expert on Biodiversity at the Strandzha Natural Park Directorate holding a masterТs degree in ecology, the property at issue belongs to terrains whose characteristic qualities are consistent with those of natural habitats of fixed grey dunes.

The judgment is final. This is the third administrative case in which the SAC find in favour of protection of the fixed grey dunes at the Kavatsite locality. RY/BR/LG
