European Court of Human Rights Finds Bulgaria Treated Prisoner Inhumanly

Strasbourg, December 17 (BTA) - The European Court of Human
Rights Tuesday notified in writing a judgment in the Case of
Dimcho Dimov v. Bulgaria, finding that Bulgaria violated Article
3 of the European Convention on Human Right which prohibits
torture, inhuman or degrading treatment and punishment.

The Court held that the applicant's immobilization for nine days
in May 2008 on a bed at the Varna Prison Medical centre, with
his wrists and ankles shackled, inflicted on him strong pain and
suffering, considering his health problems, and the continued
use of this method even after he signed a formal undertaking not
to engage in acts of self-harm was excessive and inflicted on
him strong mental suffering.

The Court also found a violation of Article 8 (right to respect
for private and family life) with regard to the monitoring of
the applicant's correspondence by the prison authorities.

Dimov was awarded 12,000 euro in non-pecuniary damage and 4,000
euro for costs and expenses.
