Parliament Adopts Conclusively Revisions to Code of Civil Procedure Concerning Matrimonial Matters and Parental Responsibility

The Parliament adopted conclusively on Wednesday amendments to the Code of Civil Procedure (CCP). The amendments provide conditions for the implementation of the provisions of European regulations, including Regulation (EU) 2019/1111 on jurisdiction, recognition and enforcement of judgments in matrimonial matters and matters of parental responsibility and on international child abduction.

The amendments introduce rules for the direct enforcement in Bulgaria of judgments, authentic instrument or agreement from another EU Member State without the need to issue a writ of execution, and regulate procedures for suspension and refusal of enforcement where there is a serious risk of a lasting nature to the child.

Amendments are also made to the Child Protection Act to clarify the provisions on interim measures in matrimonial and parental responsibility matters and on international child abduction, to regulate the procedure for the placement of a child in Bulgaria at the request of a court or competent authority of another Member State, as well as the placement of a child in another Member State.
