for Legislative Changes
over Air Quality
Sofia, November 9 (BTA) - Environmentalists are calling for amendments to the Ambient Air Quality Act which will allow citizens and non-governmental organization to challenge in court municipal air quality programmes, said Ivailo Hlebarov of the For the Nature Association at a BTA-hosted news conference on Tuesday.
The Association is appealing a refusal by the Sofia City Administrative Court to consider a complaint against Sofia's air quality programme and said it is planning to alert the Supreme Administrative Court. If the complaint is dismissed once again, the Association will refer the case to the European Court of Human Rights. Their main motive is that air quality in Sofia is not improving. Hlebarov said that non-governmental organizations should be allowed to challenge municipal programmes in court, which will improve air pollution action.
"Sofia has prepared its fourth air quality programme which is not ambitious enough and many people will continue to suffer from polluted air. Bulgaria and Poland are the only EU members whose courts don't recognize the right of citizens and non-governmental organizations to challenge air quality programmes," added Hlebarov. According to him, legislative changes will ensure that citizens will be able to exercise control over the decisions of the local authorities in connection with air quality policies. DT/PP
