Mandatory Mediation Can Be Successfully Implemented, Says Expert

The consequences of the Constitutional Court's decision from July 1 regarding mediation are an opportunity to review and rethink the repealed texts. This can be done in the conditions of a better dialogue between the participants directly interested in these processes, said in an interview for BTA lawyer Albena Komitova from the Dispute Resolution Centre.

On July 1, the Constitutional Court declared two texts from the Mediation Act and the Civil Procedure Code unconstitutional. They concerned the introduction of mandatory mediation in certain civil and commercial cases. 

Komitova explained that mediators, who invested a lot of time, effort and hopes in preparing for exams, participating in interviews and training, lost from this situation. On the one hand, this probably gave them the opportunity for better training as mediators, gaining new knowledge and self-confidence. On the other hand, that on the very day when their career as court mediators was supposed to start, it was ended, the lawyer pointed out.
