site.btaProsecutors Probe Breach of Official Duties in Issuing of Building Permit for Alepu Beach
Bourgas, on the Black Sea, August 27 (BTA) - The Bourgas
District Prosecution Office has instituted pretrial proceedings
in connection with a breach of official duties upon the issuing
of a building permit for the Alepu Beach, the prosecution office
said in a press release on Thursday.
The building permit was issued in 2018 by the chief architect of
Sozopol Municipality for two-stage construction: of a landslide
retaining wall and of a resort village in the protected area.
The prosecutors argue that this constituted a criminal offence
under Article 282 (1) of the Penal Code: a violation or a
failure by an official to fulfil his or her official duties or
exceeding his or her powers or rights for the purpose of
acquiring a benefit for himself or for another, or to cause
damage to another, from which significant harmful consequences
may ensue.
In mid-June 2020 members of the public alerted the authorities
that a four-storey building was being illegally constructed in
Alepu. The Supreme Administrative Prosecution Office asked the
National Construction Control Directorate to inspect the site,
and it found that the actual work that was being built deviated
from the approved development-project design. NV/LG
