site.btaParliament Overturns Presidential Veto on Judicial System Act Provision
September 30 (BTA) - Parliament on Wednesday overturned
149-66 a presidential veto on a provision in the Judicial System
Act. MPs from GERB, the Movement for Rights and Freedoms,
Volya, United Patriots and two independent MPs voted in favour,
and MPs from BSP for Bulgaria and seven independent MPs voted
against.
The provision concerned makes it possible for a member of the
Supreme Judicial Council (SJC), once his or her term in office
has expired, to be appointed to a higher position in the
judicial system than the one occupied before his or her election
to the Council, subject to certain eligibility conditions.
MP Kroum Zarkov of BSP for Bulgaria, who was the only one to
take the floor during the debate, said that thе provision
violates the principle of separation of powers,is voted under a
procedure which does not comply with the rules of organization
of the National Assembly and is unconstitutional.
