Supreme Administrative Court to Seek Preliminary Ruling from EU Court on BNB Deputy Governor Gyurov Case

The Supreme Administrative Court Friday decided to request a preliminary ruling from the Court of Justice of the European Union (CJEU) on the case about the dismissal of Bulgarian National Bank (BNB) deputy governor Andrey Gyurov. The case is suspended until the CJEU issues the preliminary ruling.

The case was initiated on Gyurov's appeal. On July, the BNB Governing Council decided that he must stop exercising his functions as deputy governor until a court and Parliament determine he can do that. The BNB Council acted based on a June decision of the Anti-Corruption Commission, whereby Gyurov is incompatible with the position of BNB deputy governor that he was appointed to in July 2023. Gyurov appealed the decision before the Supreme Administrative Court.

The request for a preliminary ruling was submitted at the request of Gyurov's defence. The Supreme Administrative Court asks the CJEU eight questions related to the interpretation of provisions of the Statute of the European System of Central Banks, the European Central Bank, and the Treaty on the Functioning of the European Union.
