Parliament Passes Conclusively Revisions to Public Procurement Act
Sofia, October 1 (BTA) - The ban on contracting authorities
listing requirements for the economic and financial condition,
the qualification and technical capacity in respect to
specialized enterprises and cooperatives of disabled people has
been lifted, the National Assembly decided, passing conclusively
revisions to the Public Procurement Act on Thursday.
An entirely new draft of the act has also been tabled and it
will regulate many of the problems established so far, the head
of the Legal Committee, Danail Kirilov said.
The voted texts provide that at least 80 per cent of the subject
of public procurement be implemented by specialized enterprises
or cooperatives of disabled with own production or resources,
or with subcontractors, or with the resources of third parties,
which should also be such enterprises or cooperatives.
The revisions are made in order to stem the practice of persons
who avail themselves of the preferential regime, the motives of
the Council of Ministers supporting the move say.
Another revision, which was adopted provides that the Public
Procurement Agency be relocated under the authority of the
Minister of Finance.
The Council of Ministers will also be able to establish
centralized public procurement authorities serving other
sectors, or to commission these functions to an executive
authority.
