Supreme Administrative Prosecution Office Contests EWRC Price of Natural Gas

Sofia, April 21 (BTA) - The Supreme Administrative Prosecution Office has contested a decision of the Energy and Water Regulatory Commission (EWRC) raising the price of natural gas by nearly 30 per cent, the prosecution office said.

The prosecutors have established essential violations of administrative rules as EWRC has not taken into consideration circumstances that have to be clarified by law.

The check of the Supreme Administrative Office of Prosecution related to the ordinance for the regulation of natural gas prices bin 2013. The ordinance describes the principle of abidance by the lowest costs when the price of natural gas is calculated to the feed-pipe of gas transmission companies.

According to the prosecution, basic principles of the Energy Act are also violated, including the transparency of determining the prices, because the decision does not contain certain pricing components and the manner in which they are formed.

The prosecution has also found that EWRCТs decision is against the law as it practically confirms the application of Bulgargaz AD and what has been done is not in unison with the basic rules of the operation of the independent state authority.

The violations described lead to the issuance of the contested act and mean general illegality, which complete the illegality of the whole document as a whole. That is why EWRC wants the decisions of the commission refuted in full.
